Bu Hizmet Koşulları, Asymptote oyununu ve ona bağlı hizmetleri kullanmanızın kurallarını belirleyen sözleşmedir. Adil Oyun Politikası ve Hayran İçeriği Politikası bu Koşulların parçasıdır. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız sizin için ayrıca geçerli olan hükümler, ilgili maddelerin içinde ve 16. maddede yer alır.
Özetle: Bu sözleşme sizinle, oyunu Silent Variable Studio adıyla yayımlayan Yayıncı arasındadır.
1.1. Bu Koşullar, Hizmet'i kullanan kişi ("siz") ile Hizmet'i Silent Variable Studio adıyla yayımlayan kişi ("Yayıncı", "biz") arasında akdedilir.
1.2. Bu Koşullarda sorumluluğun sınırlandırıldığı, feragat edildiği ya da koruma sağlandığı her yerde bu hüküm, Yayıncı ile birlikte Yayıncı Taraflarını da kapsar. "Yayıncı Tarafları"; Yayıncı'nın yardımcılarını, yüklenicilerini, hizmet sağlayıcılarını ve lisans verenlerini ifade eder. Bu hüküm, Yayıncı adına verilmiş bir taahhüdün kapsamını daraltmaz.
2. Kabul ve sözleşmenin kurulması
Özetle: Oyunu açtığınızda karşınıza çıkan "KABUL ET VE BAŞLA" düğmesine dokunarak bu Koşulları kabul edersiniz. Kabul etmezseniz oyunu kullanamazsınız. Gizlilik Politikası bir sözleşme değildir, kabul ettirilmez.
2.1. Sözleşme, Hizmet'i açtığınızda karşınıza çıkan ve bu Koşullara ve Politikalara ulaşabileceğiniz ekranda "KABUL ET VE BAŞLA" düğmesine dokunduğunuz anda kurulur. Düğmeye dokunmadan önce Koşulları ve Politikaları okuyabilirsiniz.
2.3. Gizlilik Politikası ve Aydınlatma Metni, verilerinizin nasıl işlendiğine dair bilgilendirme belgeleridir. Sözleşmenin parçası değildir ve kabulünüze bağlı değildir.
2.4. Bu Koşulları kabul etmezseniz Hizmet'i kullanamazsınız.
3. Tanımlar ve yorum
Özetle: Metinde büyük harfle başlayan terimler burada tanımlanır ve bütün yasal belgelerimizde aynı anlamı taşır.
3.1. Bu Koşullarda ve bunlara atıf yapan bütün belgelerde:
"Hizmet": Asymptote oyun uygulaması, oyunun web sürümü ve Yayıncı'nın bu oyunla ilgili internet siteleri ile bunların bütün özellikleri.
"Oyun": Hizmet'in parçası olan Asymptote oyunu ve oyun modları.
"Liderlik Tablosu": Oyuncuların takma adlarının ve skorlarının herkese açık olarak sıralandığı özellik.
"Takma Ad": Liderlik Tablosu'na katılırken size verilen ad.
"Skor": Oyunda elde ettiğiniz puan.
"Oyun İçi Öğeler": VEC, temalar ve oyunda kazanılan ya da açılan diğer bütün sanal öğeler.
"Cihaz Verisi": Hizmet'in cihazınızda sakladığı ilerleme, ayar ve tercihler.
3.2. "Dahil" kelimesi ve çekimleri, ardından gelen örneklerin sınırlayıcı olmadığı anlamında kullanılır.
4. Yaş
Özetle: Oyunu kullanmak için en az 13 yaşında olmalısınız. 18 yaşından küçükseniz bu Koşulları veliniz okuyup sizinle birlikte kabul etmelidir.
4.1. Hizmet'i kullanabilmek için en az 13 yaşında olmanız gerekir.
4.2. 18 yaşından küçükseniz bu Koşulları velinizle ya da vasinizle birlikte okumanız ve onun izniyle kabul etmeniz gerekir. Veliniz ya da vasiniz, Hizmet'i kullanımınızı gözetmekle sorumludur.
4.3. "KABUL ET VE BAŞLA" düğmesine dokunarak en az 13 yaşında olduğunuzu ve 18 yaşından küçükseniz velinizin ya da vasinizin bu Koşulları kabul ettiğini beyan edersiniz.
4.4. 13 yaşından küçük kişilerden bilerek kişisel veri toplamayız. Bu konuda ayrıntı Gizlilik Politikası'ndadır.
5. Kullanım izni ve fikri haklar
Özetle: Oyunu kendi eğlenceniz için oynama izni alırsınız. Oyunun kendisi ve ona ait bütün haklar bize aittir ya da bize lisanslanmıştır. Oyun bir beceri oyunudur; şans oyunu değildir.
5.1. Bu Koşullara uymanız şartıyla Yayıncı, Hizmet'i kişisel ve ticari olmayan amaçlarla kullanmanız için size münhasır olmayan, devredilemez, alt lisans verilemez, geri alınabilir ve sınırlı bir izin verir. Hayran İçeriği Politikası'nın izin verdiği kullanımlar, bu maddedeki "ticari olmayan" sınırlamanın istisnasıdır.
5.2. Hizmet'e ve Oyun'a ilişkin kaynak kod, görseller, sesler, metinler, tasarım, adlar ve logolar dahil bütün fikri ve sınai haklar Yayıncı'ya aittir ya da Yayıncı'ya lisanslanmıştır. Bu Koşullar size, 5.1. maddedeki izin dışında hiçbir hak devretmez.
5.3. Hizmet'te kullanılan üçüncü taraf bileşenler (yazı tipleri ve yazılım kitaplıkları dahil) kendi lisanslarına tabidir. Bu lisanslar uygulamanın Hakkında ekranında yer alır.
5.4. Oyun, sonucu oyuncunun becerisine bağlı bir oyundur. Oyunda para ya da parayla ölçülebilen bir ödül verilmez.
5.5. Oyunun videolarını, yayınlarını ve ekran görüntülerini paylaşmanızın kuralları Hayran İçeriği Politikası'ndadır.
6. Oyun İçi Öğeler ve ilerleme
Özetle: VEC ve temalar gerçek parayla alınamaz, parasal değeri yoktur ve size ait bir mal değildir. İlerlemeniz yalnızca cihazınızda tutulur; uygulamayı silmek ya da cihaz verisini temizlemek onu kalıcı olarak siler.
6.1. Oyun İçi Öğeler gerçek parayla satın alınamaz, paraya ya da başka bir değere çevrilemez, başkasına devredilemez. Oyun İçi Öğelerin parasal değeri yoktur ve mülkiyeti size geçmez; size yalnızca 5.1. maddedeki izin kapsamında kullanma imkânı tanınır.
6.2. Oyun dengesini korumak için Oyun İçi Öğelerin fiyatlarını, kazanım miktarlarını ve etkilerini değiştirebiliriz. Bu değişiklikler 10. madde kapsamındadır.
6.3. İlerlemeniz ve Oyun İçi Öğeleriniz yalnızca cihazınızda saklanır; bulut yedeği tutulmaz. Uygulamayı silmek, cihaz verisini temizlemek ya da cihazınızı kaybetmek bu verileri kalıcı olarak siler ve geri getirilemez. Telefon değiştirirken kullanılan cihazdan cihaza aktarım bu verileri yeni cihaza taşıyabilir, ancak bunun gerçekleşeceğini güvence altına almayız.
6.4. Ayarlar'daki Sıfırlama, Liderlik Tablosu kaydınızı siler; cihazınızdaki ilerlemeyi ve Oyun İçi Öğeleri silmez.
7. Liderlik Tablosu
Özetle: Liderlik Tablosu'na katılmak isteğe bağlıdır. Katılırsanız size bir Takma Ad verilir ve adınız en iyi skorunuzla birlikte herkese görünür. Hileli ya da hatalı skorları düzeltebilir ya da silebiliriz.
7.1. Liderlik Tablosu'na katılmak isteğe bağlıdır. Katılmazsanız skorlarınız Liderlik Tablosu'nda yer almaz.
7.2. Katıldığınızda Takma Adınız hazır bir listeden oluşturulur. Takma Adınız ve her oyun modundaki en iyi skorunuz herkese açık olarak görünür.
7.3. Skorlar sunucuda makullük denetiminden geçer. Hileli olduğundan ya da bir hatadan kaynaklandığından şüphelendiğimiz skorları düzeltebilir ya da silebiliriz.
7.4. Sunucumuza altı ay boyunca hiç bağlanmayan oyuncunun Liderlik Tablosu kaydı kendiliğinden silinir ve geri getirilemez. Bağlanmak; kaydınız varken internete bağlıyken Liderler ekranını açmak, takma adınızla tur oynamak ya da bir takma adı bildirmektir. Oyunu açıp yalnızca menüde dolaşmak ya da internetsiz oynamak bağlanma sayılmaz. Kaydınızı dilediğiniz an Ayarlar'daki Sıfırlama ile silebilirsiniz.
7.5. Takma Adınızı ve skorlarınızı Hizmet'in tanıtımında kullanmayız.
7.6. Liderlik Tablosu'ndaki verilerin nasıl işlendiği Gizlilik Politikası'nda anlatılır.
8. Davranış kuralları
Özetle: Hile yapmayın, oyunun sistemlerine zarar vermeyin ve oyunu yasalara aykırı kullanmayın. Ayrıntılı kurallar Adil Oyun Politikası'ndadır.
8.1. Adil Oyun Politikası'na uymayı kabul edersiniz. Ayrıca aşağıdakilerden kaçınmayı kabul edersiniz:
a) hile yazılımı, bot, makro ya da başka bir otomasyon aracı kullanmak;
b) Hizmet'in sunucularına, uygulamanın ve internet sitelerimizin sunduğu arayüz dışında bir yoldan erişmek (örneğin kendi yazdığınız bir programla istek göndermek ya da veri okumak);
c) Hizmet'i tersine mühendislikle incelemek, kaynak koduna dönüştürmek ya da değiştirmek;
d) Hizmet'te güvenlik açığı aramak ya da taramak;
e) Hizmet'i ya da sunucularını aşırı yükleyecek ya da bozacak bir işlem yapmak;
f) Hizmet'i yasalara aykırı bir amaçla kullanmak;
g) yukarıdakilerden herhangi birini yapmaya teşebbüs etmek ya da bir başkasını buna teşvik etmek.
8.3. Sayılmamış olsa da Oyun'un adil rekabet amacını açıkça bozan davranışlar da bu madde kapsamındadır. Böyle bir davranışı Adil Oyun Politikası'ndaki ölçütlere göre değerlendiririz.
9. Yaptırımlar
Özetle: Kurallara uymazsanız skorunuzu silebilir, Liderlik Tablosu kaydınızı kaldırabilir ya da sizi Liderlik Tablosu'ndan çıkarabiliriz. Bunu makul ve ölçülü biçimde yaparız.
9.1. Aşağıdaki hâllerden birinde skorunuzu düzeltebilir ya da silebilir, Liderlik Tablosu kaydınızı kaldırabilir ya da Liderlik Tablosu'na katılmanızı engelleyebiliriz:
a) bu Koşulların ya da Politikaların ciddi ya da tekrarlanan ihlali;
b) bir ihlal yapıldığına dair nesnel emarelerin bulunması;
c) yasal bir yükümlülüğün ya da yetkili bir makamın talebinin bunu gerektirmesi;
d) Hizmet'in teknik işleyişini ya da güvenliğini korumak için gerekli olması.
9.2. Bu yetkiyi kullanırken ihlalin ağırlığını ve koşullarını gözeterek makul, tarafsız ve ölçülü davranırız.
9.3. Sizin iletişim bilgilerinizi tutmadığımız için bir yaptırımı size ayrıca bildiremeyebiliriz. Bir yaptırıma itiraz etmek isterseniz 19. maddedeki adrese yazabilirsiniz.
10. Hizmet'in değiştirilmesi ve sona ermesi
Özetle: Oyunu geliştirebilir, dengeleyebilir ve değiştirebiliriz. Bunu ancak geçerli bir sebeple ve ücretsiz olarak yaparız. Oyunu kalıcı olarak kapatacaksak bunu makul bir süre önce internet sitemizde veya oyun içinde duyururuz.
10.1. Aşağıdaki geçerli sebeplerden biriyle Hizmet'i güncelleyebilir; özellik, mod ya da içerik ekleyebilir, değiştirebilir ya da kaldırabiliriz:
a) güvenliğin sağlanması;
b) bir yasal yükümlülüğe uyulması;
c) oyun dengesinin korunması;
d) hataların giderilmesi;
e) bir platformun ya da hizmet sağlayıcının şartlarına uyulması;
f) teknik bir gerekliliğin karşılanması;
g) Hizmet'in geliştirilmesi, yeni içerik ya da özellik eklenmesi;
h) bir özelliği sunmanın teknik ya da ekonomik olarak makul olmaktan çıkması.
10.2. Bu değişiklikler sizin için ücretsizdir.
10.3. Hizmet'i kalıcı olarak sona erdirmeye karar verirsek bunu makul bir süre önce internet sitemizde veya oyun içinde duyururuz.
10.4. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız, sizi olumsuz etkileyen değişikliklere ilişkin ek haklarınız 16. maddededir.
11. Koşulların değiştirilmesi
Özetle: Küçük bir değişiklikte yalnızca yürürlük tarihini güncelleriz. Aleyhinize ya da önemli bir değişiklik yaparsak oyunu açtığınızda yeni Koşulları yeniden kabul etmeniz istenir.
11.1. Bu Koşulları, 10.1. maddedeki sebeplerle ya da yasal bir değişiklik nedeniyle değiştirebiliriz.
11.2. Aleyhinize olmayan ve önemli sayılmayan değişikliklerde yalnızca yürürlük tarihini güncelleriz.
11.3. Aleyhinize ya da önemli bir değişiklik yaparsak, yeni Koşullar ancak siz onları Hizmet'i açtığınızda gösterilen ekranda kabul ettikten sonra sizin için geçerli olur. Kabul etmezseniz sözleşme sona erer ve Hizmet'i kullanamazsınız; Liderlik Tablosu kaydınızı aynı ekrandan ya da Veri Silme sayfasında anlatılan yollarla silebilirsiniz.
12. Garanti ve sorumluluk
Özetle: Avrupa Birliği ve Birleşik Krallık yasaları bu konuda diğer yerlerden farklı olduğu için bu maddenin iki bölümü vardır. Hangi bölüm uygulanırsa uygulansın kasıt ve ağır kusur, ölüm ve yaralanma ile yasal haklarınız saklıdır.
12.1. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız: Hizmet'i makul özen ve beceriyle sunarız. Hizmet'in yasal uygunluğuna ve güncellemelerine ilişkin yasal haklarınız saklıdır. Birleşik Krallık'ta yaşıyorsanız ayrıca, Hizmet'in makul özen göstermemiz hâlinde oluşmayacak biçimde cihazınıza ya da cihazınızdaki başka bir dijital içeriğe verdiği zarardan sorumluyuz.
12.2. Diğer ülkelerde, Türkiye dahil, yaşıyorsanız: Yürürlükteki mevzuatın izin verdiği en geniş ölçüde:
a) Hizmet "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur;
b) Hizmet'in kesintisiz, hatasız ya da her cihazda çalışacağını garanti etmeyiz;
c) dolaylı zararlardan, kâr kaybından, veri ve ilerleme kaybından, hafif kusurumuzdan kaynaklandıkları ölçüde sorumlu değiliz.
12.3. Her iki bölümde de saklıdır: kasıt ya da ağır kusurumuzdan doğan sorumluluk; ölüme ve bedensel zarara ilişkin sorumluluk; yürürlükteki mevzuatın size tanıdığı ve sözleşmeyle kaldırılamayan haklar.
13. Tazmin
Özetle: Bu Koşulları kusurlu olarak ihlal etmeniz yüzünden bir başkası bize karşı talepte bulunursa, bu talepten kusurunuz oranında sorumlusunuz.
13.1. Bu Koşulları ya da Politikaları kusurlu olarak ihlal etmenizden kaynaklanan üçüncü kişi taleplerinden doğan zararı, kusurunuz oranında Yayıncı'ya ve Yayıncı Taraflarına ödemeyi kabul edersiniz.
14. Reklamlar ve üçüncü taraf hizmetleri
Özetle: Oyunda reklam vardır. Canlanmak için reklam izlemek isteğe bağlıdır; reklam gösterilemezse canlanma da olmaz. Reklamların içeriğinden ve tıkladığınız sitelerden reklam verenler sorumludur.
14.1. Hizmet reklam içerir. Oyun sonunda canlanmak için reklam izlemek isteğe bağlıdır. Reklam gösterilemediğinde (örneğin reklam izni vermediğiniz için) canlanma seçeneği sunulmaz.
14.2. Reklamların içeriği ve bir reklama dokunarak gittiğiniz sitelerin ya da uygulamaların koşulları reklam verene ve ilgili üçüncü tarafa aittir. Yürürlükteki mevzuatın izin verdiği en geniş ölçüde bunlardan sorumlu değiliz.
14.3. Uygulamayı Google Play'den indirdiyseniz Google Play'in koşulları ayrıca geçerlidir.
14.4. Reklam ve hizmet sağlayıcılarımızın verilerinizi nasıl işlediği Gizlilik Politikası'ndadır.
15. Süre ve fesih
Özetle: Sözleşme süresizdir. Oyunu silerek ve Liderlik Tablosu kaydınızı Sıfırlama ile silerek dilediğiniz an sona erdirebilirsiniz.
15.1. Bu sözleşme belirsiz sürelidir.
15.2. Sözleşmeyi dilediğiniz an sona erdirebilirsiniz: uygulamayı silmeniz ve varsa Liderlik Tablosu kaydınızı Ayarlar'daki Sıfırlama ile ya da 19. maddedeki adrese yazarak sildirmeniz yeterlidir.
15.3. Biz sözleşmeyi 9. maddedeki hâllerde ya da Hizmet'i 10.3. madde uyarınca kalıcı olarak sona erdirdiğimizde sona erdirebiliriz.
15.4. Sözleşme sona erdikten sonra 5., 12., 13., 17. ve 18. maddeler, niteliklerine uygun olduğu ölçüde uygulanmaya devam eder.
16. Bölgeye özel hükümler
Özetle: Türkiye'de oyun anında sunulan bir elektronik hizmet olduğu için cayma hakkı yoktur. Avrupa Birliği'nde ve Birleşik Krallık'ta 14 gün içinde cayabilirsiniz.
16.1. Türkiye'de yaşıyorsanız
a) Hizmetin temel nitelikleri: Hizmet, beceriye dayalı bir mobil oyun ve isteğe bağlı bir Liderlik Tablosu'dur. Ücretsizdir ve reklam gelirleriyle desteklenir.
b) Uyumlu cihazlar: Android 7.0 ve üstü sürümlerde çalışır.
c) Teknik koruma önlemleri: Oyun İçi Öğeler cihazınızda kurcalamaya karşı imzalı saklanır; skorlar sunucuda denetlenir.
d) Cayma hakkı: Hizmet, elektronik ortamda anında ifa edilen bir hizmet olduğundan cayma hakkınız bulunmamaktadır.
e) Şikâyet ve uyuşmazlık yolları: Talep ve şikâyetlerinizi 19. maddedeki adrese iletebilirsiniz. Tüketici hakem heyetlerine, arabulucuya ve tüketici mahkemelerine başvuru haklarınız 17. maddede anlatılmıştır.
16.2. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız
a) Hizmetin tanımı ve uyumlu cihazlar: 16.1. maddenin (a) ve (b) bentleri sizin için de geçerlidir.
b) Cayma hakkı: Bu sözleşmeden, kabul ettiğiniz günden itibaren 14 gün içinde gerekçe göstermeden cayabilirsiniz. Caymak için kararınızı 19. maddedeki e-posta adresine açık bir beyanla bildirmeniz yeterlidir; bu Koşulların ekindeki örnek formu kullanabilirsiniz, zorunlu değildir. Bildiriminizi süre dolmadan göndermeniz yeterlidir.
c) Caymanın sonuçları: Cayarsanız Liderlik Tablosu kaydınız silinir ve sözleşme sona erer. Hizmet ücretsiz olduğu için iade edilecek bir ödeme yoktur. Cihazınızdaki verileri uygulamayı silerek kaldırabilirsiniz.
d) Yasal uygunluk ve güncellemeler: Hizmet'in yasal uygunluğuna ve gerekli güncellemelerin sağlanmasına ilişkin yasal haklarınız saklıdır.
e) Olumsuz etkili değişiklikler: Hizmet'te sizi önemsiz sayılmayacak ölçüde olumsuz etkileyen bir değişiklik yaparsak bunu makul bir süre önce size açık ve anlaşılır biçimde bildiririz. Değişikliğin yürürlüğe girdiği ya da size bildirildiği tarihten (hangisi sonraysa) itibaren 30 gün içinde sözleşmeyi ücretsiz olarak sona erdirebilirsiniz.
f) Ek güvence: Yasal haklarınızın ötesinde ticari bir garanti ya da satış sonrası hizmet sunmuyoruz.
g) Sözleşmenin saklanması ve dili: Sözleşme Türkçe ve İngilizce olarak sunulur. Kabul ettiğiniz sürümü kaydetmenizi öneririz; önceki sürümler Yasal Belgeler sayfasında yayımlanır.
17. Uygulanacak hukuk ve uyuşmazlıkların çözümü
Özetle: Bu sözleşmeye Türk hukuku uygulanır. Yine de yaşadığınız yerin sizi koruyan zorunlu kuralları ve oradaki mahkemelere başvurma hakkınız saklıdır.
17.1. Bu Koşullara Türkiye Cumhuriyeti hukuku uygulanır.
17.2. Türkiye'de yaşıyorsanız, tüketici olarak kendi yerleşim yerinizdeki tüketici hakem heyetine ya da tüketici mahkemesine başvurma hakkınız ve dava açmadan önce arabulucuya başvurmaya ilişkin yasal düzenlemeler saklıdır.
17.3. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız, 17.1. maddedeki hukuk seçimi, yaşadığınız ülkenin sözleşmeyle ortadan kaldırılamayan tüketici koruma kurallarının size sağladığı korumadan sizi yoksun bırakmaz. Bu kurallar Türk hukukuna ek olarak size uygulanır. Yaşadığınız ülkenin mahkemelerine başvurma hakkınız saklıdır.
17.4. Bir sorun yaşarsanız önce 19. maddedeki adrese yazmanızı öneririz. Bu bir şart değildir; yasal başvuru yollarınızı kısıtlamaz.
17.5. Bu Koşullar tahkim şartı içermez ve toplu dava hakkınızdan feragat etmenizi istemez.
18. Genel hükümler
Özetle: Bu Koşullar aramızdaki anlaşmanın tamamıdır. Bir hükmü geçersiz sayılırsa diğerleri geçerli kalır. Oyunu başka birine devredersek bu sözleşme de hakları azalmadan ona geçer.
18.1. Bütünlük. Bu Koşullar ve Politikalar, Hizmet konusunda aramızdaki anlaşmanın tamamıdır. Avrupa Birliği'nde ya da Birleşik Krallık'ta yaşıyorsanız, Hizmet'in tanıtımında ve mağaza sayfasında yapılan açıklamalar yasal uygunluk ölçüsüne ilişkin haklarınız bakımından saklıdır.
18.2. Bölünebilirlik. Bu Koşulların bir hükmü geçersiz ya da uygulanamaz sayılırsa diğer hükümler geçerliliğini korur.
18.3. Feragat yokluğu. Bir hakkımızı kullanmamamız ya da geç kullanmamız, o haktan feragat ettiğimiz anlamına gelmez.
18.4. Mücbir sebep. Makul kontrolümüz dışındaki olaylardan (doğal afetler, altyapı ya da hizmet sağlayıcı kesintileri, yetkili makam kararları dahil) kaynaklanan gecikme ya da ifa edememeden sorumlu değiliz.
18.5. Devir. Bu sözleşmeden doğan hak ve yükümlülüklerimizi Hizmet'le birlikte bir başkasına devredebiliriz. Bu Koşulları kabul ederek böyle bir devre önceden izin verirsiniz. Devralan kişi bu Koşullardan doğan bütün yükümlülüklerimizi aynen üstlenir; devir, sahip olduğunuz hakları ve güvenceleri azaltamaz. Devri internet sitemizde veya oyun içinde duyururuz. Siz bu sözleşmeden doğan haklarınızı başkasına devredemezsiniz.

These Terms of Service are the contract that sets the rules for your use of the Asymptote game and its related services. The Fair Play Policy and the Fan Content Policy form part of these Terms. If you live in the European Union or the United Kingdom, the provisions that additionally apply to you are set out within the relevant articles and in Article 16.
In short: This contract is between you and the Publisher, who publishes the game as Silent Variable Studio.
1.1. These Terms are an agreement between you, the person using the Service ("you"), and the person who publishes the Service as Silent Variable Studio (the "Publisher", "we", "us").
1.2. Wherever these Terms limit or exclude liability or give protection, they protect the Publisher Parties as well as the Publisher. "Publisher Parties" means the Publisher's assistants, contractors, service providers and licensors. This does not narrow any commitment made on the Publisher's behalf.
2. Acceptance and formation of the contract
In short: You accept these Terms by tapping the "ACCEPT AND START" button shown when you open the game. If you do not accept them, you cannot use the game. The Privacy Policy is not a contract and you are not asked to accept it.
2.1. The contract is formed when you tap "ACCEPT AND START" on the screen shown when you open the Service, from which you can reach these Terms and the Policies. You can read the Terms and the Policies before tapping the button.
2.2. The Fair Play Policy and the Fan Content Policy (the "Policies") form an integral part of these Terms; by accepting the Terms you also accept the Policies.
2.4. If you do not accept these Terms, you cannot use the Service.
3. Definitions and interpretation
In short: Terms starting with a capital letter are defined here and carry the same meaning in all our legal documents.
3.1. In these Terms and in all documents that refer to them:
"Service": the Asymptote game application, the web version of the game and the Publisher's websites relating to this game, together with all of their features.
"Game": the Asymptote game and its game modes, forming part of the Service.
"Leaderboard": the feature in which players' nicknames and scores are ranked publicly.
"Nickname": the name given to you when you join the Leaderboard.
"Score": the points you achieve in the Game.
"In-Game Items": VEC, themes and all other virtual items earned or unlocked in the Game.
"Device Data": the progress, settings and preferences the Service stores on your device.
"Policies": the documents listed in Article 2.2.
"Publisher Parties": the persons defined in Article 1.2.
3.2. "Including" and similar words introduce examples and do not limit what comes before them.
4. Age
In short: You must be at least 13 years old to use the game. If you are under 18, your parent or guardian must read these Terms and accept them together with you.
4.1. You must be at least 13 years old to use the Service.
4.2. If you are under 18, you must read these Terms together with your parent or guardian and accept them with their permission. Your parent or guardian is responsible for supervising your use of the Service.
4.3. By tapping the "ACCEPT AND START" button, you declare that you are at least 13 years old and, if you are under 18, that your parent or guardian has accepted these Terms.
4.4. We do not knowingly collect personal data from persons under 13. Details are in the Privacy Policy.
5. Licence to use and intellectual property
In short: You receive permission to play the game for your own enjoyment. The game itself and all rights in it belong to us or are licensed to us. The game is a game of skill, not a game of chance.
5.1. Provided you comply with these Terms, the Publisher grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited permission to use the Service for personal, non-commercial purposes. Uses permitted by the Fan Content Policy are an exception to the "non-commercial" limitation in this article.
5.2. All intellectual and industrial property rights in the Service and the Game, including source code, graphics, sounds, text, design, names and logos, belong to the Publisher or are licensed to the Publisher. These Terms transfer no rights to you other than the permission in Article 5.1.
5.3. Third-party components used in the Service (including fonts and software libraries) are subject to their own licences. These licences are shown on the application's About screen.
5.4. The outcome of the Game depends on the player's skill. The Game awards no money and no prize with a monetary value.
5.5. The rules for sharing videos, streams and screenshots of the Game are in the Fan Content Policy.
6. In-Game Items and progress
In short: VEC and themes cannot be bought with real money, have no monetary value and are not your property. Your progress is kept only on your device; deleting the app or clearing its data erases it permanently.
6.1. In-Game Items cannot be purchased with real money, cannot be exchanged for money or any other value, and cannot be transferred to anyone else. In-Game Items have no monetary value and ownership of them does not pass to you; you are only given the ability to use them within the permission in Article 5.1.
6.2. To keep the Game balanced, we may change the prices, earning amounts and effects of In-Game Items. Such changes fall under Article 10.
6.3. Your progress and In-Game Items are stored only on your device and are not backed up to the cloud. Deleting the app, clearing its data or losing your device erases this data permanently and it cannot be restored. The device-to-device transfer used when changing phones may move this data to the new device, but we do not guarantee that it will.
6.4. Reset in Settings deletes your Leaderboard record; it does not delete the progress or In-Game Items on your device.
7. Leaderboard
In short: Joining the Leaderboard is optional. If you join, you are given a Nickname and your name is visible to everyone together with your best score. We may correct or delete cheated or erroneous scores.
7.1. Joining the Leaderboard is optional. If you do not join, your scores do not appear on the Leaderboard.
7.2. When you join, your Nickname is generated from a ready-made list. Your Nickname and your best score in each game mode are visible publicly.
7.3. Scores go through a plausibility check on the server. We may correct or delete scores we suspect were cheated or caused by an error.
7.4. The Leaderboard record of a player who does not connect to our server at all for six months is deleted automatically and can't be restored. Connecting means, while you have a record, opening the Leaderboard screen with an internet connection, playing a round with your nickname or reporting a nickname. Opening the game and only browsing the menu, or playing offline, doesn't count as connecting. You can delete your record at any time with Reset in Settings.
7.5. We do not use your Nickname or scores to promote the Service.
7.6. How Leaderboard data is processed is described in the Privacy Policy.
8. Rules of conduct
In short: Don't cheat, don't harm the game's systems and don't use the game unlawfully. Detailed rules are in the Fair Play Policy.
8.1. You agree to comply with the Fair Play Policy. You also agree not to:
a) use cheat software, bots, macros or any other automation tool;
b) access the Service's servers other than through the interface offered by the app and our websites (for example, by sending requests or reading data with a program you wrote yourself);
c) reverse engineer, decompile or modify the Service;
d) search or scan the Service for security vulnerabilities;
e) do anything that overloads or disrupts the Service or its servers;
f) use the Service for any unlawful purpose;
g) attempt to do any of the above or encourage anyone else to do so.
8.2. Point (c) of Article 8.1 does not apply where applicable law provides that it cannot be prohibited by contract.
8.3. Conduct that clearly undermines the Game's purpose of fair competition falls under this article even if it is not listed. We assess such conduct against the criteria in the Fair Play Policy.
9. Sanctions
In short: If you break the rules, we may delete your score, remove your Leaderboard record or exclude you from the Leaderboard. We do this reasonably and proportionately.
9.1. In any of the following cases we may correct or delete your score, remove your Leaderboard record or prevent you from joining the Leaderboard:
a) a serious or repeated breach of these Terms or the Policies;
b) objective indications that a breach has been committed;
c) where a legal obligation or a request from a competent authority requires it;
d) where it is necessary to protect the technical operation or security of the Service.
9.2. We use this power reasonably, impartially and proportionately, taking into account how serious the breach is and its circumstances.
9.3. Because we do not hold your contact details, we may not be able to notify you of a sanction separately. If you wish to contest a sanction, you can write to the address in Article 19.
10. Changes to and termination of the Service
In short: We may develop, rebalance and change the game. We do so only for a valid reason and free of charge. If we are going to close the game permanently, we will announce it on our website or in the game a reasonable time in advance.
10.1. We may update the Service and add, change or remove features, modes or content for one of the following valid reasons:
a) ensuring security;
b) complying with a legal obligation;
c) keeping the game balanced;
d) fixing errors;
e) complying with the terms of a platform or service provider;
f) meeting a technical requirement;
g) developing the Service or adding new content or features;
h) a feature no longer being technically or economically reasonable to offer.
10.2. These changes are free of charge for you.
10.3. If we decide to discontinue the Service permanently, we will announce it on our website or in the game a reasonable time in advance.
10.4. If you live in the European Union or the United Kingdom, your additional rights regarding changes that adversely affect you are in Article 16.
11. Changes to the Terms
In short: For a minor change we only update the effective date. If we make a change that is to your disadvantage or significant, you will be asked to accept the new Terms again when you open the game.
11.1. We may change these Terms for the reasons in Article 10.1 or because the law changes.
11.2. For changes that are not to your disadvantage and are not significant, we only update the effective date.
11.3. If we make a change that is to your disadvantage or significant, the new Terms apply to you only after you accept them on the screen shown when you open the Service. If you do not accept them, the contract ends and you can no longer use the Service; you can delete your Leaderboard record from the same screen or in the ways described on the Data Deletion page.
12. Warranty and liability
In short: Because the laws of the European Union and the United Kingdom differ from other places on this point, this article has two parts. Whichever part applies, liability for intent and gross negligence, for death and personal injury, and your statutory rights are preserved.
12.1. If you live in the European Union or the United Kingdom: We provide the Service with reasonable care and skill. Your statutory rights regarding the conformity of the Service and its updates are preserved. If you live in the United Kingdom, we are also liable for damage the Service causes to your device or to other digital content on your device that would not have occurred had we exercised reasonable care.
12.2. If you live in any other country, including Türkiye: To the fullest extent permitted by applicable law:
a) the Service is provided "as is" and "as available";
b) we do not guarantee that the Service will be uninterrupted, error-free or work on every device;
c) we are not liable for indirect damage, loss of profit, or loss of data and progress, to the extent these result from our slight negligence.
12.3. Preserved under both parts: liability arising from our intent or gross negligence; liability for death and bodily injury; and rights that applicable law grants you and that cannot be excluded by contract.
13. Indemnity
In short: If someone else makes a claim against us because you culpably breached these Terms, you are responsible for that claim in proportion to your fault.
13.1. If a third party makes a claim because you culpably breached these Terms or the Policies, you agree to compensate the Publisher and the Publisher Parties for the resulting loss in proportion to your fault.
14. Advertising and third-party services
In short: The game contains ads. Watching an ad to revive is optional; if an ad cannot be shown, there is no revive either. Advertisers are responsible for the content of ads and the sites you tap through to.
14.1. The Service contains advertising. Watching an ad to revive at the end of a game is optional. When an ad cannot be shown (for example, because you did not give ad consent), the revive option is not offered.
14.2. The content of ads and the terms of the sites or apps you reach by tapping an ad belong to the advertiser and the relevant third party. To the fullest extent permitted by applicable law, we are not responsible for them.
14.3. If you downloaded the app from Google Play, Google Play's terms also apply.
14.4. How our advertising and service providers process your data is in the Privacy Policy.
15. Term and termination
In short: The contract has no fixed term. You can end it at any time by deleting the game and deleting your Leaderboard record with Reset.
15.1. This contract is for an indefinite term.
15.2. You can end the contract at any time by deleting the app and, if you have a Leaderboard record, deleting it with Reset in Settings or asking us to delete it at the address in Article 19.
15.3. We may end the contract in the cases in Article 9 or when we permanently discontinue the Service under Article 10.3.
15.4. Articles 5, 12, 13, 17 and 18 survive the end of the contract to the extent their nature allows.
16. Region-specific provisions
In short: In Türkiye there is no right of withdrawal, because the game is an electronic service provided instantly. In the European Union and the United Kingdom you can withdraw within 14 days.
16.1. If you live in Türkiye
a) Main characteristics of the service: The Service is a skill-based mobile game and an optional Leaderboard. It is free and supported by advertising revenue.
b) Compatible devices: It runs on Android 7.0 and above.
c) Technical protection measures: In-Game Items are stored on your device with a signature that detects tampering; scores are checked on the server.
d) Right of withdrawal: You have no right of withdrawal, because the Service is performed instantly in electronic form.
e) Complaint and dispute channels: You can send your requests and complaints to the address in Article 19. Your rights to apply to consumer arbitration committees, to mediation and to consumer courts are described in Article 17.
16.2. If you live in the European Union or the United Kingdom
a) Description of the service and compatible devices: Points (a) and (b) of Article 16.1 also apply to you.
b) Right of withdrawal: You can withdraw from this contract without giving any reason within 14 days from the day you accepted it. To withdraw, it is enough to inform us of your decision by a clear statement sent to the email address in Article 19; you may use the model form annexed to these Terms, but you do not have to. It is enough to send your notice before the period expires.
c) Effects of withdrawal: If you withdraw, your Leaderboard record is deleted and the contract ends. Because the Service is free, there is no payment to refund. You can remove the data on your device by deleting the app.
d) Legal conformity and updates: Your statutory rights regarding the conformity of the Service and the provision of necessary updates are preserved.
e) Changes with adverse effects: If we make a change to the Service that adversely affects you in a way that is not minor, we will inform you clearly and comprehensibly a reasonable time in advance. You can end the contract free of charge within 30 days from the date the change takes effect or the date you are informed of it, whichever is later.
f) Additional guarantees: Beyond your statutory rights, we do not offer a commercial guarantee or after-sales service.
g) Storage and language of the contract: The contract is provided in Turkish and English. We recommend that you keep the version you accepted; previous versions are published on the Legal Documents page.
17. Governing law and dispute resolution
In short: Turkish law governs this contract. Even so, the mandatory rules that protect you where you live and your right to go to the courts there are preserved.
17.1. These Terms are governed by the law of the Republic of Türkiye.
17.2. If you live in Türkiye, your right as a consumer to apply to the consumer arbitration committee or consumer court of your place of residence, and the legal rules on applying to mediation before filing a lawsuit, are preserved.
17.3. If you live in the European Union or the United Kingdom, the choice of law in Article 17.1 does not deprive you of the protection afforded to you by the consumer protection rules of your country of residence that cannot be excluded by contract. Those rules apply to you in addition to Turkish law. Your right to go to the courts of your country of residence is preserved.
17.4. If you have a problem, we recommend that you first write to the address in Article 19. This is not a requirement and does not restrict your legal remedies.
17.5. These Terms contain no arbitration clause and do not ask you to waive your right to bring a class action.
18. General provisions
In short: These Terms are our entire agreement. If one provision is found invalid, the others remain valid. If we transfer the game to someone else, this contract passes to them without reducing your rights.
18.1. Entire agreement. These Terms and the Policies are our entire agreement about the Service. If you live in the European Union or the United Kingdom, this does not affect your rights where statements made in promoting the Service or on its store page form part of the conformity standard.
18.2. Severability. If any provision of these Terms is found invalid or unenforceable, the other provisions remain valid.
18.3. No waiver. If we do not use a right, or use it late, we have not waived it.
18.4. Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control (including natural disasters, infrastructure or service provider outages and decisions of competent authorities).
18.5. Assignment. We may transfer our rights and obligations under this contract to another party together with the Service. By accepting these Terms you consent in advance to such a transfer. The transferee assumes all our obligations under these Terms unchanged; the transfer cannot reduce your rights and safeguards. We will announce the transfer on our website or in the game. You may not transfer your rights under this contract to anyone else.
18.6. Language. These Terms are published in Turkish and English. If the two texts conflict, the Turkish text prevails; this provision does not affect the protections preserved in Article 17.3.
18.7. Notices. Because we do not hold your contact details, we publish notices to you on the Legal Documents page or in the game.
18.8. Feedback and suggestions. We may use the feedback and suggestions you send us to improve the Service without paying you; this gives you no payment or other right. This provision does not affect rights that the law provides cannot be excluded by contract.
